Welcome to HOMEHOSTER™. These Terms and Conditions ("Terms") govern your access to and use of the HOMEHOSTER™ website, mobile application, and services (collectively, the "Service"). HOMEHOSTER™ is operated by NORDSPITZ Digital Solutions ("we", "us", or "our"), with its headquarters in Austria.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.
By accessing or using HOMEHOSTER™, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use our Service.
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of HOMEHOSTER™ after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by the modified Terms.
You must be at least 14 years old to use HOMEHOSTER™. By using the Service, you represent and warrant that you meet this eligibility requirement. If you are under the age of 18, you represent that you have obtained parental consent to use the Service and agree to these Terms.
4.1. To access certain features of HOMEHOSTER™, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4.2. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password.
4.3. You must notify us immediately of any unauthorized use of your account or any other breach of security.
5.1. Our Service allows you to create and share content related to event planning and hosting ("User Content"). You are solely responsible for your User Content and the consequences of posting or publishing it.
5.2. By posting User Content on HOMEHOSTER™, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Service.
5.3. You agree not to use the Service to:
a) Post any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
b) Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
c) Upload or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
d) Interfere with or disrupt the Service or servers or networks connected to the Service.
e) Violate any applicable local, state, national, or international law or regulation.
6.1. We collect and process personal data as described in our Privacy Policy. By using HOMEHOSTER™, you consent to such processing and you warrant that all data provided by you is accurate.
6.2. We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption of sensitive data both in transit and at rest.
6.3. As HOMEHOSTER™ is available globally, your information may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction.
7.1. The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of HOMEHOSTER™ and its licensors.
7.2. The HOMEHOSTER™ name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of HOMEHOSTER™ or its affiliates or licensors. You must not use such marks without our prior written permission.
8.1. We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
8.2. You may terminate your account at any time by contacting us and requesting account deletion.
8.3. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
To the maximum extent permitted by applicable law, in no event shall HOMEHOSTER™, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
These Terms shall be governed and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.
We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.
